-The validity of the trademark is 10 years from the date of registration with unlimited renewal.

- Trademark is a sign that identifies goods and services of different merchants.
- Trademark may consist of words (including personal names), signs, design pattern, letters, typefaces, numbers, graphic elements, colors, sounds, odors, the shape of the goods or their packaging, and any combination of the above elements.
- A mark which can be expressed by writing or drawing can be registered as a trademark.
Once a trademark is registered, it has exclusive the using rights for the goods and services.
If other merchants use the trademark in Hong Kong for the same or similar goods or services without consent, it is an infringement and owner can take legal action in this regard.
If the trademark is not registered, it is more difficult to prove the “owner” of the trademark and the protection of the goods and services are limited.

If you have not registered your trademark and have used ®, it is an offence and is liable on conviction to a fine.
Where a trademark is registered, the registration is valid for 10 years from the date of registration.
